Disclaimer and terms of use

1. Who we are

"BoardHawk", "we" and "us" mean the provider of the BoardHawk software and this website. You can reach us at contact@showmyplane.com. These terms are between us and the business or person who installs or uses BoardHawk ("you"). BoardHawk is meant for transport businesses and their staff, not for consumers.

2. What BoardHawk is

BoardHawk is a browser extension that runs on the Amazon Relay UK load board in your own browser, while you're signed in to your own Relay account. It can refresh the board, mark loads, play sounds, book loads when you press ACCEPT or switch on auto-book, post trucks, cancel posts and assign drivers – always by sending the same requests Relay's own page sends from your browser. It doesn't ask for, read or store your Amazon password, and it stops when Relay shows a sign-in page, a captcha or a bot warning.

3. Your responsibilities

• You're responsible for your Relay account and for complying with Amazon's terms, programme policies and any instructions Amazon gives you. If you're unsure whether a tool like BoardHawk is allowed for your account, check with Amazon before using it.
• You choose BoardHawk's settings – including filters, search speed, auto-book and its delay – and you're responsible for their effect.
• Every load booked through BoardHawk is a booking you make on your account. You're responsible for having a suitable driver, vehicle and trailer, for meeting the load's requirements, and for any cancellations.
• You'll keep your licence key to yourself and your business. Keys may not be shared, sold or published.
• You won't try to copy, change, take apart or get round BoardHawk's licence checks, and you won't use BoardHawk to harm Amazon's systems or other users.

4. Free trial and keys

• The free trial lasts 7 days from when you start it, on up to three browsers, with one Relay company account. There is one trial per e-mail address, per browser and per Relay company account.
• A key gives you a licence to use BoardHawk – not to own it – for the period, number of browsers and Relay account it was issued for. It's personal to your business and can't be transferred.
• We may pause, shorten or end a trial or key that is shared, misused or used against these terms, and we may end the trial offer at any time. When a trial or key ends, BoardHawk stops refreshing; your settings stay in your browser.
• BoardHawk checks your key with our licence server when you enter it and every 48 hours.

5. Changes to Relay and to BoardHawk

Amazon can change the Relay website, its requests or its rules at any time, and that can stop BoardHawk working, fully or partly, without warning. We'll try to keep BoardHawk working and may release updates, but we can't promise that every feature will always be available.

6. No warranty

As far as the law allows, BoardHawk is provided "as is" and "as available", without any warranty or condition of any kind – including that it will be uninterrupted, error-free, fit for a particular purpose, or that it will find or book any load.

7. Limits of our liability

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited or excluded by law.

Otherwise, as far as the law allows, we won't be liable for: loss of profit, revenue, business, loads or opportunities; any action Amazon takes on your account; bookings, cancellations, fees, fines or penalties; loss of data; or any indirect or consequential loss. Our total liability to you for anything to do with BoardHawk is limited to the amount you paid us for BoardHawk in the 12 months before the claim. For a free trial, that amount is nil.

9. Changes to these terms

We may update these terms. The version date is shown at the top of this page, and the trial box in BoardHawk records which version you accepted. If a change matters, we'll ask you to accept the new version.

10. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
